As money and talent flow into agricultural technology companies, entrepreneurs and investors must think strategically about how their company is structured and how and when investments are taken. These decisions will affect their ability to scale up, to commercialize IP, to attract future funding, and to grow or successfully “exit.” AgTech is similar in this regard to other venture-backed emerging growth industries. Nevertheless, individual businesses within each segment of AgTech (i.e., bioenergy, food e-commerce, soil & crop tech, indoor agriculture, waste mitigation, smart-equipment & hardware, decision-analytics & software, drones, robotics, etc.) have different go-to-market strategies, and we will discuss how these differences affect their approach to legal issues.
